Terms of use.

The rules for using this website. Short version: read what you like, don’t attack anything, and don’t mistake a marketing page for a contract.

Scope

These terms cover the website. Not your software licence.

This page sets out the terms on which you may use aitakeoff.com. It applies whether you’re a visitor, a customer, or someone kicking the tyres before a demo.

What it isn’t is your ZeroCount licence agreement. The £55 per licence per month subscription is agreed separately, at the point you subscribe, and that agreement — not this page — governs the software itself. We don’t invent licence terms on a web page. See pricing for what the subscription costs, and clause 07 below for how the two documents sit together.

The terms
01

Who we are

aitakeoff.com is operated by [Registered company name], a company registered in England and Wales under company number [company number], with its registered office at [registered office address]. Below, “we”, “us” and “our” mean that company.

ZeroCount is the AI takeoff product of the Ensign group. Its development was supported by Innovate UK Smart Grants, awarded October 2021.

02

Accepting these terms

By using this site you confirm that you accept these terms and agree to comply with them. If you don’t accept them, please stop using the site. Whichever version is published on this page at the time you use the site is the version that applies.

03

Using this site

You may view, download and print pages from this site for your own use, or for the internal use of the business you work for. That’s as far as the permission goes.

You must not:

  • attempt to gain unauthorised access to this site, the server it runs on, or any system connected to it;
  • introduce viruses, trojans, worms or any other malicious or technologically harmful material;
  • attack the site by denial-of-service or any similar means;
  • systematically extract, scrape or republish material from the site, whether to build a competing service or for any other purpose;
  • use our enquiry forms to send unsolicited marketing, or to submit information you know to be false;
  • reproduce our content commercially without our written permission.

Breaching these terms ends your right to use the site immediately. Where a breach is also a criminal offence we will report it to the relevant law-enforcement authorities and co-operate with them, including by disclosing your identity.

04

Our intellectual property

We own or are licensed to use all intellectual property rights in this site and in the material published on it. Those works are protected by copyright and trade mark laws. All such rights are reserved.

“ZeroCount”, “Ensign”, our logos and our product names are our marks. Nothing on this site gives you a right to use them.

The takeoff method behind the product is protected by UK patent GB2631290. Reading about how it works here grants you no rights in it.

05

The information on this site

We take real care to keep this site accurate, and we’d rather be corrected than left wrong. But the content is published for general information. It isn’t professional advice, and it isn’t a warranty.

Figures, timings, supported file formats and integration claims describe the product as it stands at the time of writing, and the product changes. Nothing here is a promise that ZeroCount will produce a particular result on your drawings — that is exactly what the demo and trial account are for. Run it on your own material before you commit.

To the extent the law allows, we exclude all warranties, express or implied, as to the accuracy or completeness of anything published on this site.

06

What we say about other products

Some pages compare ZeroCount with other takeoff software, including products we name — see our comparison page. Those comparisons are drawn from publicly available information at the time of writing: the other supplier’s own website and published material, and third-party review sites. Where the public record doesn’t answer a question, we say so rather than assert an answer.

We don’t control that information. It may be incomplete, out of date, or since have changed. Nothing on those pages is endorsed by, affiliated with, or approved by the companies named, and any trade marks mentioned belong to their respective owners. Check the current position with the supplier before relying on it — and if you think we’ve got something wrong, tell us and we’ll correct it.

07

Prices, and where the licence terms actually live

The published price is £55 per licence per month, excluding VAT. UK customers are charged VAT on top at the prevailing rate, currently 20%. Multi-licence rates and annual billing are quoted separately, on request.

Prices and package details on this site are an invitation to discuss, not a contractual offer, and we may change them. A change to the price published here does not by itself change what you pay under a subscription already in place — your subscription agreement governs that.

Your ZeroCount licence is a separate contract, agreed when you subscribe. It sets out what you get, what you pay, how billing and cancellation work, and what each of us owes the other. Nothing on this website forms part of it, varies it, or overrides it. If the two ever appear to disagree, your subscription agreement wins.

08

Links to other websites

Where this site links out — to Ensign, to sources cited in comparisons, or anywhere else — those links are provided for information only. We don’t control those sites, we don’t endorse their content, and we accept no responsibility for any loss arising from your use of them.

You may link to our home page, provided you do so fairly and legally and in a way that doesn’t damage our reputation or suggest an association or endorsement that doesn’t exist. You must not frame this site within another site.

09

Enquiries you send us

If you complete a form on this site — a demo request, for instance — you are asking us to get in touch, and we will use the details you give us to do that. How we handle personal data is set out in our privacy policy.

Please give us accurate details, and don’t submit someone else’s personal information without their knowledge.

10

Availability of the site

We don’t guarantee that this site, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of it without notice, for business or operational reasons.

You are responsible for arranging your own access to the site, and for making sure that anyone accessing it through your internet connection is aware of these terms.

11

Our liability to you

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, and liability for fraud or fraudulent misrepresentation.

This site is aimed at business users. If you use it in connection with your trade, business or profession then, to the extent the law allows, we exclude all implied conditions and warranties, and we will not be liable to you for loss of profit, loss of business, business interruption, loss of anticipated savings or loss of goodwill, or for any indirect or consequential loss, arising out of your use of or reliance on this site or anything published on it.

If you are a consumer, this clause does not affect your statutory rights.

This clause is about the website. It does not affect the liability either of us has under a ZeroCount subscription agreement, which stands on its own terms.

12

Changes to these terms

We may amend these terms from time to time. The version published on this page is the one that applies, and the date it last changed is shown at the top. Check back occasionally — if we make a material change, we’ll say so here.

13

Governing law

These terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with them.

Contact

Something here needs correcting? Tell us.

Questions about these terms, or something on the site you think is wrong — email [legal contact email address], or write to us at [address for notices]. We’d rather fix it than leave it standing.

If it’s the product you want to talk about rather than the paperwork, book a demo and we’ll run a takeoff on a drawing of your choice.
